End-User License Agreement & Terms of Service

1. Agreement to Terms

By accessing or using the Techno Survey Solutions website (www.technosurveys.co.za) and services, including our QuickBooks integration, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Techno Survey Solutions provides professional surveying services, including:

• High-precision drone surveying and RTK surveys
• Conventional land surveying
• 3D modeling and point cloud generation
• Orthomosaic mapping and volumetric analysis
• Visual progress tracking and documentation
• Automated estimate generation via QuickBooks integration

3. QuickBooks Integration License

3.1 Grant of License

When you authorize our QuickBooks integration, you grant us limited access to your QuickBooks account solely for the purpose of:

• Creating and managing customer records
• Generating estimates based on your service requests
• Updating estimate status and information

3.2 Scope of Access

Our integration only accesses the "Accounting" scope of QuickBooks Online. We do not:

• Access payment information or banking details
• Modify or delete existing transactions
• Share your QuickBooks data with third parties
• Use your data for any purpose other than estimate generation

3.3 Revocation

You may revoke our access to your QuickBooks account at any time through your QuickBooks account settings or by contacting us directly.

4. User Responsibilities

You agree to:

• Provide accurate and complete information
• Maintain the security of your QuickBooks account credentials
• Notify us immediately of any unauthorized access
• Use our services in compliance with all applicable laws
• Not interfere with or disrupt our services

5. Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, and software, are owned by Techno Survey Solutions and protected by copyright, trademark, and other intellectual property laws.

6. Service Deliverables

6.1 Survey Data Ownership

Upon full payment, you will own the final deliverables (point clouds, orthomosaics, reports) for your specific project. Raw data and intermediate files remain the property of Techno Survey Solutions.

6.2 Data Accuracy

While we strive for the highest accuracy, survey data is provided "as-is" and should be verified for critical applications. We are not liable for decisions made based solely on our survey data.

7. Payment and Billing

• Estimates are provided through our QuickBooks integration
• Payment terms will be specified in each estimate or contract
• We reserve the right to suspend services for non-payment
• All fees are in South African Rand (ZAR) unless otherwise stated

8. Limitation of Liability

To the maximum extent permitted by law, Techno Survey Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use our services
• Unauthorized access to your data
• Errors or interruptions in service
• Third-party integrations (including QuickBooks)

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Techno Survey Solutions from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

10. Third-Party Services

Our QuickBooks integration is provided by Intuit Inc. Your use of QuickBooks is subject to Intuit's Terms of Service. We are not responsible for any issues arising from QuickBooks or other third-party services.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including for violation of these Terms. Upon termination:

• Your QuickBooks integration access will be revoked
• You must cease all use of our services and website
• Provisions that should survive termination will remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to arbitration in South Africa.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or website notice. Continued use of our services after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Techno Survey Solutions.
